- 요약The U.S Government security agencies, such as the National Security Agency (NSA), the Federal Bureau of Investigations (FBI), and the local police, have been surveilling Muslims more than other targeted groups since September 11, 2001. Using telecommunications and digital surveillance programs, these agencies monitor Muslim populations across states, ranging from those with large Muslim demographics like New York and New Jersey to states with smaller Muslim populations such as Pennsylvania. This surveillance stems from the misconception that Muslims, based on their religious beliefs, pose a threat to American society. This dissertation examines the legal implications of the surveillance conducted primarily by U.S. security agencies concerning the freedom of religion and association for Muslim Americans. It highlights concerns about the chilling effect resulting from state monitoring, which indirectly affects the exercise of First Amendment rights, particularly freedom of religion and association. The research delves into the potential violation of American Muslims' constitutional rights under the First Amendment due to surveillance operations by government security agencies. Furthermore, it proposes a legal framework aimed at enabling U.S. lawmakers to either cease or mitigate the surveillance activities targeting Muslims in the country.
